59-2207. Venue of actions against fiduciaries. Any fiduciary may be sued in the district court of the county in which he or she was appointed, or in which he or she resides. If the fiduciary does not reside in the county of his or her appointment, service may be had upon the fiduciary by serving a summons in the county of his or her residence.

CASE ANNOTATIONS

1. Probate court has exclusive original jurisdiction of wrongful death demand against deceased wrongdoer's estate. Shively v. Burr, 157 Kan. 336, 341, 346, 139 P.2d 401.

2. Guardian may be sued in county where he resides. Texas Co. v. Sloan, 171 Kan. 182, 185, 231 P.2d 255.

3. Action for breach of executor's duties must be brought in court where probate proceeding is pending. Quinlan v. Leech, 5 Kan. App. 2d 706, 709, 623 P.2d 1365.
