61-2701. Citation of act. This act shall be known and may be cited as the "small claims procedure act."

1. Judgment rendered during period when neither party entitled to counsel or jury trial reversed and remanded. Windholz v. Willis, 1 K.A.2d 683, 573 P.2d 1100.

2. Actions under residential landlord and tenant act (58-2540 et seq.) may be filed under this act when claims within statutory limitation. Barton v. Miller, 225 K. 624, 625, 592 P.2d 921.

3. Mentioned in case concerning peaceable entry and forcible detainer. Koerner v. Custom Components, Inc., 4 K.A.2d 113, 122, 603 P.2d 628.

4. District court hearing small claims appeal de novo cannot grant judgment beyond scope of small claims jurisdiction. Armstrong v. Lowell H. Listrom & Co., 11 K.A.2d 448, 725 P.2d 540 (1986).

5. While not specifically provided for, successful appellee allowed reasonable attorney fee on final appeal. Vogel v. Hanes, 11 K.A.2d 454, 457, 730 P.2d 1096 (1986).
