60-510. Effect of limitations prescribed. Civil actions, other than for the recovery of real property, can only be commenced within the period prescribed in the following sections of this article, after the cause of action shall have accrued.

1. Statute begins to run when tort is committed, now when physician-patient relationship ceased. Hill v. Hays, 193 Kan. 453, 457, 395 P.2d 298.

2. Even though filing of answer in state court works waiver of defense of defective service, similar waiver does not occur in federal court. Panhandle Eastern Pipe Line Company v. Brecheisen, 323 F.2d 79, 83.

3. Filing of bankruptcy tolls state statute of limitation as to the bankrupt estate. Harman v. Willbern, 227 F. Supp. 892, 894.

4. Limitation period here provided is not extended by failure of litigation where action is in federal court. Evers v. Powell, 238 F. Supp. 787, 789.

5. Survival of causes of action in tort and in contract; limitation tolled on action for breach of implied warranty on execution of will. Price, Administrator v. Holmes, 198 Kan. 100, 102, 422 P.2d 976.
