CASE ANNOTATIONS

1. Manufacture of methamphetamine is a felony under statute cited. State v. Lamae, 268 K. 545, 998 P.2d 106 (2000).

2. Instruction on word "manufacture" as defined in 65-4101 properly denied. State v. Bowen, 27 K.A.2d 122, 999 P.2d 286 (2000).

3. "Own use" exception of 65-4101 is not an element of crime of manufacturing methamphetamine in violation of 65-4159; defendant has burden of showing application of exception. State v. Gunn, 29 K.A.2d 337, 26 P.3d 710 (2001).

4. Offense of manufacturing controlled substance is properly charged under 65-4159; attempt to manufacture is charged under 21-3301. State v. Martens, 29 K.A.2d 361, 28 P.3d 408 (2001).
